It's always nice to post a story before /., though admittedly the news.com story they link to is not as upbeat as EFF's version. I didn't realize that the job of the US justice system was to duck making rulings on controversal issues. This issue is sure to raise it's head again, so saying the "claims are moot" is not quite true.

On courts ducking issues, I suppose the general theory is (and I'm sure a few of your other loyal readers can back me on this) that the court system exists to resolve disputes between parties, not make bold statements of law. If a court can find a way to dispose of a potential hotbed of thorny legal issues with a quick (usually procedural) decision, they will certainly do so.

On another note, what happened to the Blue/Red color scheme in the "KissaBoo" logo? Trademark problems?

Now I have been forced to read the actual order of the judge (direct link on EFF).

Unfortunately, I think I will have to read the other documents to get the complete picture, but even if the convenant by the media companies to not sue the 5 ReplayTV owners who brought forth the case applied for all future time, which is doubtful with no power of enforcement, that still leaves the thousands of ReplayTV owners (including me) open to the cost of having to defend ourselves for using a perfectly legal device.

What upsets me about this ruling is
a) how could it have taken this long to decide to decide nothing?
b) These features do not infringe on copyrights (especially commercial skipping), so why not be straightforward and make the declaration - the real threat of lawsuits still exist.
